07/05/2021 (Agence Europe) – In a Chamber judgment handed down on Friday 7 May, the European Court of Human Rights condemned Poland, inter alia, for violating the right to “a court established by law”. The judges in Strasbourg consider that the composition of the five-judge panel of the Polish Constitutional Court that examined the case brought by the turf company Xero was unconstitutional. This is the first time they have spoken out against the reform of the Polish judicial system introduced in 2017 and 2018. Both parties have three months to appeal to the Grand Chamber. The latter has also announced a hearing scheduled for 19 May in another Polish case, this time concerning a judge at the Administrative Court whose term of office was abruptly interrupted by the entry into force of the reform.
