MEPs adopt new rules to strengthen rail passengers’ rights

On Thursday 29 April, the European Parliament adopted at second reading the proposal to introduce new rules on protection and compensation for rail users who face delays, cancellations, or discrimination.

In detail, the text foresees that passengers will have the option, in case of a delay of more than 60 minutes, to choose to be reimbursed for the full amount of their ticket, to continue their journey, or to be re-routed, without additional costs, under similar conditions.

In addition, alternative re-routing options will have to be communicated within 100 minutes, failing which passengers will be able to plan their own journeys - including with another operator - and obtain a refund of the new ticket. Meals, refreshments, and accommodation will be provided. 

People with reduced mobility will be able to travel with assistance after a 24-hour pre-notification period from 30 June 2026, compared to 48 hours currently. 

The new regulation also clarifies the situations that qualify as force majeure, which could exempt operators from compensation. These include extreme weather conditions, major natural disasters, severe public health crises, and terrorist attacks. However, staff strikes are not included in the list of exemptions. 

Finally, in order to promote alternative and sustainable mobility, all trains will have to be equipped with racks and at least one storage space for at least four bicycles.

This regulation will enter into force 20 days after its publication in the Official Journal of the European Union and will start to apply within 2 years at the latest. The requirements for bicycle parking will be applicable within 4 years after the entry into force of the regulation. (Original version in French by Thomas Mangin)
