EU Council Presidency proposes to strengthen role of Member States in energy infrastructure planning process by revising TEN-E Regulation

The Portuguese Presidency of the Council of the European Union sent to the Member States, on Tuesday 6 April, new proposals for the revision of the EU Regulation (347/2013) on Trans-European Energy Networks (TEN-E). These include strengthening the role of Member States in the cross-sectoral energy infrastructure planning process. 

According to the Presidency document obtained by EUROPE, Lisbon retains the approach proposed by the European Commission (see EUROPE 12623/3, 12618/9) whereby the European Networks of Transmission System Operators for Electricity (ENTSO-E) and for Gas (ENTSO-G) would be responsible for submitting to the Member States, the Commission and the Agency for the Cooperation of Energy Regulators (ACER) their respective draft methodologies for a “harmonised analysis” of the costs and benefits of projects of common interest (PCIs) concerning the EU’s whole energy system.

Nevertheless, the Presidency suggests that, within three months of receiving the methodologies, Member States and the Commission should be able to give an opinion on these methodologies by forwarding them to ACER and, where appropriate, to the transmission system operators (ENTSO). In the Commission’s proposal, this advisory role on methodologies is reserved for ACER.

The transmission system operators should then update their methodologies taking into account not only of the Agency’s opinion but also of those of the Commission and the Member States.

Furthermore, Lisbon wants the interconnected energy market and network model developed by ENTSO to be updated every four years once approved.

The Portuguese document also foresees that in addition to the Commission and organisations representing all stakeholders such as network operators (gas and electricity transmission and distribution), Member States should also be consulted by ACER prior to the publication of their framework guidelines for the elaboration of scenarios for the ‘Ten Year Network Development Plan’ (TYNDP).
