Court clarifies conditions for forced transfer between two EU countries of a third-country national with refugee status

24/02/2021 (Agence Europe) – The Returns Directive (2008/115) does not preclude a Member State of the European Union from holding a third-country national illegally residing on its territory in administrative detention in order to forcibly transfer that person to another Member State in which he or she enjoys refugee status, the European Court of Justice ruled on Wednesday 24 February (Case C-673/19).
