29/07/2019 (Agence Europe) – The European Commission launched a public consultation on Monday 29 July on its draft communication to assist national courts in dealing with requests to disclose confidential information in proceedings for the private enforcement of EU competition law on the initiative of the private sector. In the context of the application of this legal framework, national courts may receive requests for disclosure of evidence containing confidential information from citizens or companies. Courts must then strike a balance between access to and protection of this information, which is why the Commission has drawn up a draft communication on the subject.
