05/12/2018 (Agence Europe) – On the occasion of the first anniversary of the legislative package on intellectual property, on Wednesday 5 December, some thirty companies and associations from different high value-added economic sectors are asking, in a letter to Andrus Ansip, the Commissioner for the Digital Single Market, to ensure that the principle of proportionality with regard to patents is respected. In particular, the signatories call for the submission of a new set of guidelines that would contain a list of factors for national courts to consider when deciding on remedies for patent infringement. According to the signatories, patent holders abuse threats of injunctions on a patented product, not for the purpose of removing a product from the market, but to extract royalties. In its package adopted in November 2017, the Commission undertook to present guidelines by 2019. (PH)
