The preliminary list of sectors and sub-sectors exposed to carbon leakages over the period 2021-2030 based on criteria set out in the EU’s emissions trading system (ETS), as established by the European Commission, will be presented and discussed with all stakeholders, in Brussels on 16 May 2018, the Commission announced on 8 May.
The draft list was published that same day in the EU Official Journal (2018/C 162/01). It contains 44 sectors that qualify directly for the carbon leakage list, as well as 12 sectors and 16 sub-sectors/products which are eligible to apply for further assessments (based on criteria set out in the revised EU ETS Directive (EU) 2018/410 for post-2020) that will determine whether they also qualify to be put on the carbon leakage list (see EUROPE 11970).
The preliminary list was established by delegated act, as stipulated in the directive. Prior to its adoption, two public consultations were held, as well as bilateral meetings with the parties concerned – industry, member states, NGOs and academics.
The ETS remains the EU’s main market instrument for attaining, at least cost, its climate objectives and for implementing the Paris agreement. The aim of the reform for the fourth trading period was to enhance that instrument in order to address the excess of quotas on the market, while safeguarding the competitiveness of European heavy industry by protecting it against the risks of relocation.
