Poland under spotlight regarding EU regulation on gas supply security

08/03/2018 (Agence Europe)On Thursday 8 March, the European Commission sent a letter of formal notice to Poland for failing to comply with EU requirements on the security of gas supply regulation (2017/1938).  The Commission reproaches the Polish legislation by imposing a gas storage obligation on undertakings importing gas to Poland.  The conditions of that obligation make storage less attractive and more cumbersome abroad than in Poland.  EU rules authorise member states to impose certain gas supply security obligations as long as they do not distort competition or hamper the functioning of the internal market, the Commission states, considering the Polish storage obligation incompatible with these rules.  Poland has two months in which to answer the arguments raised by the Commission.  Otherwise, the Commission may send a reasoned opinion and refer the matter to the Court of Justice (CJEU).  (EH)
