On Thursday 8 March, the European Commission filed an appeal of non-compliance against Croatia, at the European Court of Justice (ECJ), which it believes is guilty of failing to update its national legislation on civil aviation safety, under the terms of Regulation No. 300/2008.
This regulation makes it compulsory for member states to regularly update the legislation on aviation safety. This involves updating the rules defining the organisational bodies and systems highlighting responsibility and the mechanisms for monitoring the activities of the national airports through the airlines and actors involved in aviation safety. These rules therefore aim to ensure that any safety problem is identified and corrected as soon as possible.
Although the Commission sent a letter of notification and a reasoned opinion to the Croatian authorities in April and October 2017 respectively, the latter have not, according to the Commission, updated the legislation concerned, which exclusively relates to related administrative aspects and not those pertaining to the essential substance. This is why the Commission decided to file an appeal of non-compliance against Croatia, at the ECJ. (Original version in French by Lucas Tripoteau)
