Notion of 'spouse' includes same-sex persons within the meaning of the 'freedom of movement' director, says Advocate General

Member states cannot prevent a spouse in a same-sex couple who is a third-country national from settling in the country of the EU in which his or her spouse is exercising his or her freedom of movement as a European citizen, even if this state does not officially recognise same-sex marriage, Advocate General Melchior Wathelet stated in conclusions adopted on Thursday 11 January (case C-673/16).
