15/12/2017 (Agence Europe) – On Friday 5 December, the Luxembourg government decided to submit an application for annulment at the General Court of the European Union against the European Commission decision of 4 October last. This decision called on Amazon to repay the Grand Duchy the sum of €250 million (see EUROPE 11876). The Commission considers that the company benefited from an illegal advantageous tax regime between 2006 and 2004, corresponding to state aid prohibited by Union law. In a press release, the Luxembourg authorities explain that the Commission, “has not established the existence of a selective advantage within the meaning of article 107 TFEU”. Furthermore, the authorities of the country do not share the analysis of the Commission regarding the transfer prices. The Luxembourg government finally adds that it is committed, “to tax transparency and the fight against harmful tax practices”. (LT)
