A state cannot be forced to execute European arrest warrant against a minor if the acts in question are not against its national law

In conclusions returned on Wednesday 6 September (case C-367/16) Advocate General Yves Bot concluded that a member state is within its rights to refuse to hand a minor over to another member state if the minor in question would not have been punished under the law of the state asked to carry out the extradition, taking account of the minor's age at the time the infringement was committed.
