02/03/2017 (Agence Europe) – On Thursday 2 March, the Court of the Justice of the European Union confirmed that the cost of a call to an after-sales telephone number should not exceed that of a standard call (see EUROPE 11665). This case (C-568/15) is expected to clarify the notion of the “basic price” included in the directive on consumer rights. Under this directive, member states have to ensure that when a business uses a contact telephone line on the subject of contracts concluded with consumers, the latter should not be made to pay more than the basic price for the calls to this line. Given that the notion of “basic price” had not been defined in the directive, the Court has just stated that it should correspond, to a standard call. (JK)
