Appeal against state aid for Hinkley Point nuclear plant thrown out

30/09/2016 (Agence Europe)The European General Court has rejected an appeal by a German electricity supplier, Greenpeace Energy, and nine other renewable energy companies against the European Commission’s decision to allow the United Kingdom to give state aid for the Hinkley Point nuclear power plant (see EUROPE 11267).  In a ruling published on Friday 30 September (Case T-382/15), the General Court said that the appellants had failed to demonstrate that they were individually affected by the Commission’s decision for three reasons – the fact that some of the companies had been involved in the formal assessment procedure prior to the decision they are appealing against does not amount to being individually affected; there is no substantial damage to the companies’ competitive position on the electricity market; and the environment and energy policy objectives pursued by the companies do not establish that they are individually affected by the Commission’s decision. (JK)
