Brussels, 20/05/2016 (Agence Europe) - On Friday 20 May, the EU filed a notice of appeal at the WTO regarding the verdict of the WTO's dispute settlement body (DSB) on Argentina's complaint about EU anti-dumping duties imposed on Argentine biodiesel (DS 473).
At the end of March, the WTO found Argentina partly right on this issue (see EUROPE 11521). The DSB panel of experts tasked with ruling in the complaint recognised that certain aspects of the anti-dumping investigation led by the EU into Argentine biodiesel were incompatible with the WTO's anti-dumping agreement. The EU was therefore asked to take the necessary measures to comply with the WTO rules.
By contrast, the DSB panel of experts rejected Argentina's allegation that an article in the EU regulation establishing anti-dumping duties against Argentine biodiesel was “in itself” an infringement of the WTO's anti-dumping agreement. (Original version in French by Emmanuel Hagry)
