Amendment soon to food supplement legislation

Brussels, 27/01/2015 (Agence Europe) - EU law on food supplements is about to be amended, after the Council decided on Monday 26 January not to oppose two European Commission implementing regulations.

The first adds (6S)-5-methyltetrahydrofolic acid in the form of glucosamine salt as a source of folate to the list of vitamins and minerals that can be used in the manufacture of food supplements. This regulation follows on from a favourable opinion by the European Food Safety Authority (EFSA). It will amend Directive 2002/46/EC.

The second submits the substance yohimbe to EU examination and bans the herb Ephedra and its preparations in foods. This regulation will amend Annex II of European Parliament and Council Regulation (EC) No 1925/2006 on adding vitamins, minerals and certain other substances to foodstuffs.

The two texts are subject to the comitology procedure with examination procedure. The Council now having given its assent, the Commission regulations will be deemed to have been adopted if the European Parliament does not raise any objections.

By virtue of a European Commission implementing decision (Commission Decision 2014/154/EU), the marketing of (6S)-5-methyltetrahydrofolic acid in the form of glucosamine salt is authorised as a new food ingredient under Parliament and Council Regulation (EC) No 258/97. (AN)
