Right to be forgotten - national authorities and search engines meet

Brussels, 18/07/2014 (Agence Europe) - The Article 29 group, which brings together the national authorities for the protection of personal data in the EU, will meet representatives of search engines on 24 July, to discuss the consequences of the ruling of 13 May returned by the Court of Justice of the EU on the right to be forgotten, the group has announced in a press release.

They will discuss the implementation, firstly by Google and then, shortly afterwards, by Microsoft, of request forms for links to be deleted from the internet and the grounds on which the search engines may refuse to get rid of these links.

According to the ruling of the Court of Justice of the European Union (CJEU), certain users are entitled to ask search engines to remove research results which include their name, as long as the said results are “irrelevant, outdated or otherwise inappropriate” in regard to the purposes of processing. In the framework of the application of this decision, “we will assess each individual request and will try to strike a fair balance between protecting the privacy of individuals and the right of the public to access and distribute this information”, Google explained at the time.

The CJEU took the view that under certain conditions, individuals could have links to webpages containing personal details removed and stated that this option should not be systematic. The Article 29 group is preparing guidelines on this subject, for the autumn. (SP)
