Poznan, 25/11/2011 (Agence Europe) - On Thursday 24 November, the European Commission decided to take Germany and Poland before the EU Court of Justice for failure to implement European rules on transport.
Germany has not implemented common rules on interoperability for the rail transport system in Europe, as provided for in two specific directives - Directive 2008/110/EC which strengthens the level of security of the European rail transport network, and Directive 2008/57/EC aimed at creating the necessary conditions for achieving interoperability of the rail transport system in Europe. The Commission intends to call on the Court to impose a daily fine on Germany until that country has adopted national measures.
Poland, too, has also been referred to the Court, but for failings in the aviation sector. It has yet to put in place the procedures set out in Directive 847/2004 imposing certain obligations on member states to ensure that transparent and non-discriminatory national procedures exist for the allocation of limited air traffic rights. Poland is one of the few countries still to apply the regulation, in breach of the single market in air transport. (MD/transl.jl/rt)
