Brussels, 05/11/2009 (Agence Europe) - The draft agreement between the EU and the United States on the transfer of data held by the company "Swift" is to be confirmed at a meeting of the JHA Council to be held on 30 November and 1 December. As it stands, this draft agreement provides for Swift data to be transmitted solely for the purposes of the fight against terrorism. Reciprocity in data transmission is on the cards, particularly to benefit Europol and Eurojust. The agreement also makes provisions on data protection. A maximum period of five years for the data to be held is also specified (unless an investigation is opened). A right of administrative or legal recourse must also be made available to the owner of the data. A joint re-examination of the agreement will be carried out after six months. Unless the parties decide otherwise, the agreement will end 12 months after its signature, meaning that it is temporary in nature. As of the date on which the Lisbon Treaty enters into force, new negotiations will be undertaken to conclude a new international agreement in the legal and institutional framework of the new treaty (EUROPE 9979).
