10/11/2005 (Agence Europe) - On Thursday, the European Commission presented a second code of conduct on transfer pricing for EU related companies. The Commission suggests that “transfer pricing” documentation be set up, standardised, and composed of a masterfile common to all cross-border companies, and a specific part for each Member State. The aim is to show that transfer pricing should be established at a fair level and for conflicts between tax authorities of different Member States to be avoided. (EUROPE will come back to this). At the end of 2004, the Council had adopted a first code of conduct to eliminate double taxation in cross-border price transfer cases (see EUROPE 8844).
