01/04/2009 (Agence Europe) - The European Commission, which originally planned to adopt its proposal for a regulation on successions and testaments on Wednesday 1 April (3 and 6 April have also been mentioned as possible dates), has finally decided to postpone its decision. The main problems concern the principle of “compulsory hereditary reserve”, which is foreseen in the draft text. The United Kingdom and Ireland, however, support the Anglo-Saxon concept which gives preference to the “life donation system”. With a view to satisfying these two states, which are able to exert their opt-in on the text, the president of the European Commission, José Manuel Barroso, decided on Tuesday evening to postpone presentation of the proposal till after 20 and 21 April, when the Czech Presidency is organising a conference in Prague on civil law.
