ERG pleased that Commission leaves national regulators free to choose best remedies for their markets

Brussels, 12/11/2008 (Agence Europe) - The European Regulators Group (ERG) has welcomed the European Commission's revised proposals on the electronic communications legislative package, made in the light of amendments brought by the European Parliament (see EUROPE 9779). Consensus is emerging in favour of retaining the central role of national regulators, who are best placed to ensure that the market operates properly, said ERG Chairman Dániel Pataki. Further improvements still have to be made with regard to remedies and procedures for implementing them, he went on. The Commission stated in its amended proposal that national regulators could be required to amend or withdraw projects which the Commission or the new Body of European Regulators in Telecommunications deem unsatisfactory. “The ultimate decision on how to best repair local market deficiencies should rest with the respective national regulatory authority most qualified to assess the situation - this is the enshrinement of the subsidiarity principle,” Pataki said.
