15/07/2008 (Agence Europe) - On Friday 11 July 2008, the European Court of Justice concluded a case using the new emergency procedure for the first time. In Case C-195/08, the Court backed the appeal by German national Michel Rinau, whose daughter Luisa (born in 2005) had been taken to Lithuania by her Lithuanian mother in 2006. The mother refused to let her daughter return to Germany. The Court of Justice's ruling confirms a ruling by the Oranienburg Court of First Instance in Germany making the decision that she should be returned to Germany enforceable under EU legislation (the Brussels II Regulation 2201/2003/EC). The new emergency procedure came into force in March 2008 (see EUROPE 9616). It only applies to questions for preliminary rulings in the field of freedom, security and justice. (C.D./transl.fl)
