Brussels, 18/02/2008 (Agence Europe) - On Thursday 14 February, the European Commission presented the Council with a proposed regulation recommending that the partial interim re-examination of anti-dumping duty applied to imports of ammonium nitrate from Russia be concluded, and that this duty be kept in place.
On 19 December 2006, the Commission opened an interim re-examination of measures applicable to imports of ammonium nitrate from Russia further to a request brought by two Russian producer-exporters, OJSC Acron and OJSC Dorogobuzh. The request was based on elements of proof which showed, at first glance, that the circumstances underpinning the measures had changed and that it was no longer necessary to keep measures in place at the existing levels to counterbalance any dumping.
The Commission's investigations showed that dumping practices persist. It even noted that the level of dumping was higher than that established at the investigation which led to the institution of definitive duty. According to the Commission, this level is higher than the level for the elimination of the damages, which is behind the measures currently in force. The Commission concludes, therefore, that no change has occurred to indicate that the measures instituted to counterbalance dumping are no longer necessary. The Commission also noted that the circumstances prevailing over the current investigation period were sustainable in nature. It is therefore calling on the Council rapidly to adopt its proposal to ensure that the regulation is published in the Official Journal no later than 18 March. (O.L.)
