EDPS expresses concern about European PNR

Brussels, 21/12/2007 (Agence Europe) - The European Data Protection Supervisor (EDPS), Peter Hustinx, issued an opinion on Friday 21 December whereby he expresses deep concern about the recent proposal for a framework decision on the use of passenger name records (PNRs) for law enforcement purposes (EUROPE 9536). The proposal involves obligations for air carriers to transmit data about all passengers on their flights to or from an EU member state. While acknowledging that the fight against terrorism is legitimate, the EDPS expresses deep concern about the necessity and proportionality of the proposal which, in his view, are not sufficiently established in the proposal. He also criticises the lack of clarity when it comes to various aspects of the proposal, especially the applicable legal framework, the identity of the recipients of personal data, and the conditions of transfer of data to third countries. The EDPS also recommends that the draft decision should not be adopted before entry into force of the new Lisbon Treaty so that the European Parliament is fully involved in the adoption process.
