14/12/2007 (Agence Europe) - On 11 December, the Court of Justice ruled that a Community regulation can apply in a member state only after it has been published in the Official Journal of the Communities and in the language of the member state in question (case C-161/06). Czech wine importer Skoma-Lux was accused of submitting incorrect information on the customs classification of its imports. However, since the appropriate European regulation (EC No 2454/93) only appeared in the Official Journal in Czech on 27 August 2004, Skoma-Lux cannot be pursued for its actions before that date, although the regulation had previously been made available in other media and in other languages.
