Luxembourg, 17/07/2007 (Agence Europe) - On Tuesday 17 July the Court of Justice announced that it would be reached a decision on the T-201/04 case - Microsoft versus the European Communities, on 17 September 2007 at 9H30. This case focuses on the Commission's decision on 24 March 2004 that indicated that an abuse of dominant position by Microsoft had taken place due to two distinctive examples. The first consists in its refusal to provide certain competitors with “information on interoperability” of work group user systems. In the meantime, Microsoft published a document on this subject, which is currently being examined in an effort to determine whether it had responded to the Commission's requests. The second example in which the Commission sanctioned Microsoft is the sales of the Window multimedia Media Player using Windows software. The Commission affirmed that this practice affected competition on the multimedia player market. On 7 June 2004, Microsoft lodged an appeal at the Court of First Instance, in which it sought to overrule this decision or substantially reduce the fine of more than €497 million imposed on the company. A Microsoft spokesperson said that “We look forward to receiving the court's judgement and continue to work with industry and governments on the best way to serve the needs of customs and communities in Europe.
