Spanish government considers relaxing preconditions for E.ON-Endesa merger

Brussels, 26/10/2006 (Agence Europe) - On Thursday, the European Commission confirmed that it received an answer from the Spanish government on Wednesday evening to the Commission's warning letter last week (see EUROPE 9289). The Commission has launched infringement proceedings against Spain, which it suspects of not meeting its obligation to scrap conditions set by the Spanish energy regulator CNE on the merger deal between German electricity company E.ON and Spanish electricity company Endesa. On Thursday, Spanish economics minister Pedro Solbes said in Madrid that Spain was prepared to revise only some of the nineteen conditions but Reuters reports that he would not be drawn on which ones in particular. If the Spanish authorities drag their feet over informing the European Commission of the measures they are considering to remove obstacles judged to run counter to EU law, the next stage in the infringement proceedings may be launched with the sending of a Reasoned Opinion to Spain.
