Legislation adopted on data retention

Brussels, 21/02/2006 (Agence Europe) - Ministers meeting on Tuesday at the JHA Council in Brussels adopted by qualified majority the Commission's proposal on the directive on telecommunications data retention in the fight against terrorism and organised crime. A text was finally approved in codecision with the European Parliament, which approved some of the compromise in a first reading last December (EUROPE 9089). Ireland had indicated that it would appeal to the Court of Justice and did not support the text on the basis that Article 95 of the EU Treaty is not an suitable legal basis. Irish Secretary of State Frank Fahey said that they wanted to work in the remit of the third pillar. The question of the legal basis was also raised by Slovakia, which did not approve the proposal either.
