Agreement in sight on future European Order for Payment

Luxembourg, 12/10/2005 (Agence Europe) - In Luxembourg on Wednesday, most Member States came out in favour of a uniform procedure for the production and examination of evidence for the draft European Payment Order. Only Belgium and Poland still oppose such standardisation, but the decision will be taken by qmv so political agreement may be reached by the end of the year, explains the Council in its conclusions. The draft regulation presented by the Commission in March 2004 is a priority for 2006 in the Action Plan on the Implementation of The Hague Programme. The uniform procedure under the European Payment Order foresees the provision of a description of proof of payment to be provided along with requests for payment of debts in other Member States, and without actually having to provide such a description (an invoice for example). The forum would include an exhaustive list as possible of the type of proof usually provided and would be accompanied by a statement of good faith by the person requiring payment of the debt on the validity of the proof. Courts could then rule prima facie on the foundation of a request for payment and exclude requests which, according to the description accompanying them, are not set out in sufficient detail.
