23/07/2004 (Agence Europe) - Electricité de France has reacted to our article on the Court of Justice ruling on the "étang de Berre" case (bulletin of 21 July, p.16), sending us the following text (our translation): "The decision returned by the Court of Justice on 15 July 2004, in response to the preliminary question of the French Cour de Cassation, did not comment on the conformity to the applicable law of the outlets of fresh water from the Saint-Chamas power station into the 'étang de Berre'. This assessment will be made by the French competent jurisdiction to which the matter will be referred by the Cour de Cassation after the anticipated cancellation of the ruling of the Aix-en-Provence Court".
