European Parliament challenges legal base used by Council for adopting regulation on European Cooperative Society

Luxembourg, 03/12/2003 (Agence Europe) - The European Parliament calls on the European Court of Justice to annul the Council regulation of 22 July 2003 (see EUROPE of 25 July) on the statute for a European Cooperative Society because the legal base used is not the right one, it states. The Parliament does not challenge the effect of this regulation, since it calls on European judges to maintain them until the Council adopts a new regulation "within a reasonable period on a proper legal basis". The regulation was adopted on the basis of Article 308 of the EC Treaty providing for unanimous Council decision after consultation with Parliament. The latter considers it should have been based on Article 251 EC as, it recalls, the Commission had proposed in its initial proposal of 6 March 1992 as well as in its amended proposal of 6 July 1993.
