Brussels, 02/10/2003 (Agence Europe) - Following the EU Court of First Instance's cancellation of the fines that the Commission had imposed on the maritime company members of the Trans-Atlantic Conference Agreement (TACA) for abuse of a dominant position (see EUROPE 15 November 2002 p 11), the European Commission has indicated in a press statement that it is "disappointed" by the decision. "We will now have to study the judgement carefully to see whether there are any grounds to appeal or, alternately what lessons should be drawn from that annulment". The Commission is said, on the other hand to be pleased to see that the court had followed its fundamental logic, namely, that the TACA agreement could not benefit from exemptions.
