12/06/2003 (Agence Europe) - With the adoption of a report by Spanish Christian Democrat Marcelino Oreja, the European Parliament rejected the Council's proposed decision defining the criteria and practical arrangements for offsetting financial imbalance resulting from application of the 2001 directive on mutual recognition of expulsion decisions against third country nationals. This rejection is linked to a disagreement of the EP on the legal basis of the original directive, which had led it to reject the text. In substance, the report signs up to the compensation mechanism which allows a Member State carrying out a decision of expulsion taken in another State to obtain reimbursement from the latter for costs incurred to this end.
