Strasbourg, 09/07/2002 (Agence Europe) - The European Parliament has unanimously adopted the report by Spanish Socialist Luis Berenguer Fuster on the Commission's Green Paper relating to review of the Council EC Regulation No 4064/89 on mergers, for which the European Executive began a vast period of consultation ending 31 March this year. The Parliament felt that the current Regulation has produced good results and is pleased to note the review process implemented by the Commission that will bring greater effectiveness. It deplores, however, the fact that, on some points such as replacement of the dominant position and questions linked to jurisdictional appeal, later reforms are envisaged. It requests that, in the event of merger between innovative companies, a balance be sought between the large-scale needs of the research and development sector, the needs for catching up delays in European industry, and the requirements for maintaining a reasonable state of competition. It considers that, in order to assess the increased efficiency produced by a merger, it is mainly appropriate to assess those which have an effect on the economy in general and on consumers. It also notes that the investigative body and the decision-making body are not separate and considers that this state of affairs is hardly compatible, in principle, with the fundamental requirements of legal security.
