Infringement procedure against Germany over light quadricycles

Brussels, 16/05/2002 (Agence Europe) - On 15 May, the European Commission sent Germany a reasoned opinion calling on it to review its legislation on the driving licences required to drive light quadricycles. These are vehicles of less than 350 kg, the maximum speed of which is limited to 45 km/h and of no more that 500 CCs for engines with automatic starters or whose maximum power does not exceed 4kw/h for other types of engines. The German legislation on the reception and conformity of vehicles (StVZO) and legislation relating to driving licences (FeV) make a distinction between vehicles equipped with petrol engines and those with diesel engines. The former may be driven with a class "B" licence or former "Klasse 5" which is easier to get, whereas only holders of class "B" driving licences may drive diesel engine quadricycles. On the basis of Articles 28 to 30 of the Treaty, the European Commission considers this distinction to be unwarranted and to be an obstacle to the sale of light diesel engine quadicycles, which are mostly ,manufactured in other Member states. Germany has to months on receipt of the reasoned opinion to provide the Commission with a satisfactory response, otherwise it will be taken before the Court of Justice.
