Brussels, 27/12/2001 (Agence Europe) - The European Commission has announced that it is to ask the Court of Justice to impose a daily penalty of 316,500 euro for not complying with its obligations regarding the prevention and sanction of landing and marketing of undersized fish. European rules in the mater are intended to prevent the fishing and landing of immature fish as immature fish are fished without their having been able to reproduce. On 11 June 1991, the Court had already reprimanded France for failing to respect its obligations. The failure observed were in the order of four, which were the minimum mesh sizes of fishing nets, the use of devices in fishing nets to reduce their selectivity, the legal composition of the catches and the minimum landing sizes of fish. Since then, the Commission has noted improvements, but considers that inadequacies remain, especially in the supervision of the landed and marketing of undersized fish. Despite a reasoned opinion sent in 1996 and 2000, France has not taken the adequate measures. The Commission has therefore asked the Court of Justice to impose a daily fine for delays in the execution of its obligation, fine set at 316,500 euro a day and which will be suspended as soon as France assumes its responsibilities.
