Luxembourg, 20/10/2000 (Agence Europe) - Germany calls on the Court of Justice to cancel the decision by the European Commission, on 11 April 2000 (see EUROPE of 13 April), enjoining it to recover some DM 140 million in State aid in favour of Systeem Microelectronic Innovation.
The German government considers that the Commission could not declare the financial measures adopted by Treuhandanstalt (see the above EUROPE) and by the BvS institution that succeeded it as incompatible with the common market. It considers that this decision has major vices of motivation. Berlin accuses the Commission of using excessive power as it forces it to recover aid from third parties that did not receive such aid and which do not have the possibility to take part in the procedure.
