On Thursday 16 July, the European branch of the International Lesbian, Gay, Bisexual, Trans and Intersex Association (ILGA-Europe) published its annual inventory of case law on LGBTI rights before the European Court of Human Rights (ECHR) and the Court of Justice of the European Union (CJEU).
The report shows that 15 countries are responsible for the 35 new cases and 45 new judgments between January 2025 and May 2026 identified within it.
Bulgaria tops the list with six cases, followed by Russia (with four), and Hungary and the Czech Republic (with three each). The disputes mainly concern the recognition of same-sex couples, totalling 12 cases; hate crimes and hate speech, comprising 10 cases; and also asylum applications, accounting for six.
In particular, ILGA-Europe highlights the significance of the judgment in Commission v. Hungary, in which the CJEU held that Hungarian anti-LGBTI legislation also overlooked the values enshrined in Article 2 of the Treaty on European Union.
The organisation additionally cites the ‘Shipova’, ‘Mousse’, ‘Deldits’, and ‘Cupriak-Trojan’ judgments on the rights of transgender persons and recognition of same-sex marriages.
