European Commission publishes three calls for evidence on Carbon Border Adjustment Mechanism

On Thursday 28 August, the European Commission opened three calls for evidence on the future effective implementation of the Carbon Border Adjustment Mechanism (CBAM). From 1 January next year, operators will not only have to declare the CO2 emissions contained in their imports, but also purchase and surrender CBAM certificates corresponding to the emissions. However, certain rules still need to be defined before this new phase can begin. 

For example, the European Commission needs to put in place an implementing regulation to establish the rules for converting the carbon price already paid in a third country into CBAM certificates. Under the basic regulation, carbon emissions from products that have already been subject to carbon pricing will not be taxed twice.

A methodology and rules must also be established to ensure that the surrender of CBAM certificates takes into account the allocation of free ETS allowances in certain sectors within the EU. The aim is not to tackle carbon leakage from a given sector or product twice, which would put international competition at a disadvantage.

Finally, the Commission has yet to specify its method for determining the volume of emissions contained in products. This relates both to the calculation based on actual emissions and the default values.
