European Commission consults on first revision of Digital Markets Act

On Wednesday 27 August, the European Commission launched a public consultation on how the Digital Markets Act (DMA) can promote a “fairer” environment.

The primary objective of the DMA is to facilitate competition in the digital environment and enable new players, particularly SMEs, to emerge in the face of the large dominant platforms.

As part of this first review of the text, the Commission is publishing a call for evidence and a questionnaire on the impact of artificial intelligence on the objectives of the Act.

Its aim is to assess the effectiveness of the DMA, its effect on consumers and businesses, and to identify possible improvements in the face of the new challenges posed by digital services, particularly those powered by AI.

This move comes against a backdrop of persistent tensions between the EU and the United States over digital legislation (see EUROPE 13671/13).

Donald Trump’s government regularly criticises the EU for targeting American industry giants - Google, Apple, Meta - through its legislation, whereas the Commission defends the need for erga omnes European rules, which ignore the nationality of companies, to promote fair competition and consumer protection (see EUROPE 13695/1).

Contributions are open until 24 September. The Commission’s report on this revision of the DMA will be presented to the European Parliament, the Council and the European Economic and Social Committee in May 2026.
