MEPs deem directive on AI liability “premature” and “superfluous

Meeting in the Internal Market and Consumer Affairs Committee (IMCO) on Tuesday 20 May, MEPs approved their draft opinion on the AI Liability Directive (ILD), the withdrawal of which the Commission announced in February is not going down well with some MEPs (see EUROPE 13618/11).

In its draft opinion, adopted by 32 votes to 15, the IMCO Committee rejects the text of the directive as proposed by the Commission outright.

The adoption of an AI Liability Directive at this stage is premature and unnecessary. At this stage, there is no demonstrated legal gap or market failure justifying a separate AI Liability Directive”, the document explains in detail.

The rapporteur of the opinion, Kosma Złotowski (ECR) from Poland, has always been very opposed to the implementation of the directive.

Several of his colleagues, members of Patriots for Europe and Renew Europe, have also spoken out against the Commission’s proposal.

The IMCO Committee calls on the Committee on Legal Affairs (JURI), as the committee responsible, to reject the Commission’s proposal.

Axel Voss (German, EPP), rapporteur for the text in JURI, was in favour of maintaining the text (see EUROPE 13567/9).

A first version of the draft report is scheduled for 4 June. The votes in the JURI committee, then in plenary, are not expected to take place before the early months of 2026.
