On Thursday 1 August, the European Union Agency for Fundamental Rights (FRA) published guidelines for labour inspectors to better protect migrant workers from exploitation.
In a document entitled “Six Points for Workplace Inspectors – EU Law Safeguards for Non-EU Workers”, the FRA lists key actions to protect the rights of migrant workers in the EU.
Of these points, one of the most important is informing employees of their rights. Migrants, who are often poorly informed, need to be made more aware of their rights through targeted campaigns and on-site visits.
Involving legal professionals is also key: the aim is to encourage workers to report abuse without fear of repercussions, even if they are in an irregular situation.
Inspectors also play a decisive role in detecting cases of exploitation and referring victims to support organisations.
In addition, workers must receive full remuneration for their work, whatever their situation, and be provided with decent housing that meets standards such as access to running water, electricity and adequate sanitation. Finally, the right to change employer must be guaranteed.
A practical handbook is due to be published in autumn 2024 to supplement these recommendations and provide further support for labour inspectors in their work.
