European branch of International Lesbian, Gay, Bisexual, Trans and Intersex Association is calling for greater awareness to strengthen Rule of law and protect rights of LGBTI people in Europe

In its submission to the European Commission’s report on the Rule of law, published on 28 February, ILGA-Europe, the European branch of the International Lesbian, Gay, Bisexual, Trans and Intersex Association, points out the consequences of the weakening of the Rule of law for these people. 

This document, drawn up with the expertise of its member organisations in seven countries (Bulgaria, Hungary, Italy, Poland, Romania, Slovenia and Spain), sets out major concerns, including the non-implementation of judgments by the European Court of Human Rights, which affects the right of LGBTI people to respect for their private and family life, and attempts to manipulate judicial processes, particularly in Poland and Hungary, to erode their rights. 

The report also condemns shortcomings in gender recognition procedures, which are deemed not to comply with international standards in four of the seven countries studied. 

The study also found that hate crimes are not sufficiently monitored. In Spain, for example, although the number of hate crimes recorded by the State over the last 5 years is 1,551, the survey ‘Estado del odio: Estado LGTBI+ 2023’, carried out by the FELGTBI+ federation, reveals that the actual number of complaints lodged is close to 50,000 over the same period, indicating a problem of under-detection.

Finally, in 2023, defenders of LGBTI rights continued to face legal harassment, threats and defamation campaigns.
