26/09/2023 (Agence Europe) – Representatives of the European Parliament and the Spanish Presidency of the Council of the EU will discuss the legal presumption of salaried employment and the criteria for triggering this presumption at a new negotiating meeting on the directive on digital platform workers on 3 October, several sources told EUROPE on Tuesday 26 September. The principle of the legal presumption of salaried status is the most complex point in the negotiations, the Council of the EU having retained in its mandate the need for a worker to ‘tick’ three out of five criteria of subordination in order to be considered as an employee, whereas the European Parliament has chosen to remove these criteria from the body of the text and has made them voluntary to help determine the right employment status.
