18/09/2023 (Agence Europe) – The Spanish Presidency of the EU Council reportedly no longer intends to put the regulation on the removal of online child sexual abuse material on the agenda of the Justice and Home Affairs Council on 28 September. While “the decision has yet to be made”, according to one source, the latest agenda, dated 18 September, for the Council’s preparatory meeting on Wednesday 20 September, makes no further mention of a possible general approach to this regulation, presented in May 2022. Last week, at the end of a final working group, the Presidency reportedly felt that positions were not yet developed enough to move towards an agreement, according to another source. This regulation is highly controversial in that it authorises a form of surveillance of private online communications by platforms in order to track down child sexual abuse content, in particular via detection orders.
