Aviation safety—European Commission consults in order to revise criteria and rules related to operating bans

On Wednesday, 28 September, the European Commission launched two consultations on updating the common criteria for the EU Air Safety List and on defining the rules applicable to noncommercial flights operated by air carriers that have been hit with an operating ban.

Specifically, the first of the two consultations should enable the list of criteria—which identifies the factors to be taken into consideration in order to determine whether or not to impose a ban or operational restrictions—to be revised.

With this initiative, the European Commission intends to emphasise improving the EU toolbox for the safety oversight of non-EU air carriers and strengthening synergies between the regulation on third-country operators and the regulation establishing the list of airlines that are banned in the EU.

The second consultation actually aims to establish rules for updating the list of air carriers that are subject to an operating ban or operational restrictions in the EU.

The work will concern the establishment of the EU list, its update, any exceptional measures adopted by a Member State, the exercise of air carriers’ right of defence, and the implementation of the EU list by Member States. 

Both consultations will remain open until 26 October.
