EU Council’s Code of Conduct Group will be invited to continue its examination of tax measures notified by Member States

The ‘Economic and Financial Affairs’ Council, which will meet on Tuesday 4 October in Luxembourg, is expected to approve the work programme of the Council’s Code of Conduct Group on business taxation that damages the internal market.

According to the document obtained by EUROPE, the programme is based on six points: - monitoring of standstill and the implementation of rollback; - monitoring the implementation of agreed guidance; - revision of the Code of Conduct; - links with third countries; - the OECD agreement on minimum taxation of companies; - the organisation of the work.

As regards the follow-up of standstill and rollback notifications, the Group will have to monitor the evolution of Member States’ administrative practices and will continue to examine the tax measures notified by Member States.

In line with its adopted priority list, the Group will continue to assess Member States’ compliance with the 2017 Guidance on tax privileges for special economic zones (see EUROPE 11784/1).

The Group will also have to continue to work on the development of national regimes for the exemption of foreign-source income. In June, the EU Council had invited the Group to continue an effective dialogue with countries and jurisdictions engaged in this reform, those with no or low taxes and those affected by the implementation of the country-by-country reporting anti-BEPS (base erosion and profit shifting) minimum standard (see EUROPE 12975/30).

The Group will also continue to monitor the implementation of commitments made by non-cooperative jurisdictions (see EUROPE 13029/16).

The Group will continue to work at a technical level to assess the possible impacts of Pillar II of the OECD Minimum Tax Agreement on its work, including on the EU listing criteria (see EUROPE 13029/17).

Finally, a meeting of the Group is scheduled for Wednesday 23 November.
