DMA, Member States discuss Slovenian EU Council Presidency compromise

On Wednesday 10 November, the Member States’ ambassadors to the European Union (Coreper) discussed the Slovenian Presidency’s compromise proposal for a political agreement in principle (‘general approach’) on the Digital Markets Act (DMA) (see EUROPE 12821/8) at the next Competitiveness Council on 25 November.

As a reminder, the text proposes, among other things, that the status of gatekeepers be reviewed every 4 years and also specifies, in order to avoid a national concentration effect, the obligations in the field of acquisitions made by gatekeepers (see EUROPE 12814/9).

In addition, the text requires gatekeepers to inform the European Commission of planned or already concluded acquisitions.

For its part, in the area of unfair practices, the Commission would have the ability to launch an investigation to determine whether the obligations contained in the text are sufficient and appropriate. These could be updated at the initiative of the Commission or if three EU Member States request it.

The document analysed by Coreper members also provides details on the competences of Member States and national authorities, on the room for manoeuvre left to gatekeepers, and on security guarantees for users.
