15/07/2021 (Agence Europe) – The European Data Protection Board (EDPB) on Thursday 15 July adopted a decision to compel the Irish Data Protection Commission (DPC) to investigate changes to the terms of use of the messaging application WhatsApp. The EDPB had been referred by the competent German authority, which had decided, citing an urgent situation, to prohibit Facebook, the parent company of WhatsApp, from using the data collected by its application. The EDPB did not consider this to be an urgent matter and, in view of the “high probability of infringements”, nevertheless instructed the DPC to investigate again without further delay. The European Consumers’ Organisation (BEUC) had already announced on Monday 12 July that it had filed complaints against WhatsApp with the European Commission and consumer protection authorities following the app’s privacy policy changes (see EUROPE 12760/11).
